scalenow AI Additional Terms
scalenow AI Additional Terms (“scalenow AI“) govern your access and use of any scalenow AI features and form part of the Terms of Use or Master Services Agreement (the “Agreement”) between you and scalenow AI.
Any capitalized terms not defined in these Terms will have the meaning assigned in the Agreement. References to “Customer Data” in these scalenow AI Terms also refer to User Content as defined in the Terms of Use.
If you do not wish to use scalenow AI or disagree with these Terms, you may disable scalenow AI in your Workspace.
1. What is scalenowAI?
scalenow AI refers to the tools, features, and functionalities provided through the scalenow AI platform that utilize machine learning and artificial intelligence. These include, but are not limited to:
- Generating short-form or long-form content through AI-based prompting.
- Editing and extracting information from existing content.
- Translating generated or existing content.
2. Use of Your Data
Your use of scalenow AI does not grant scalenow AI the right to use or share your Customer Data in any way that conflicts with the Agreement unless explicitly agreed by you.
3. Input and Output Data
- You may provide input for processing by scalenow AI (“Input”), and receive AI-generated content (“Output”).
- Both Input and Output are considered your Customer Data under the Agreement.
- You are solely responsible for:
- The content, operation, maintenance, and distribution of your Input and Output.
- Ensuring that your use of scalenow AI complies with all laws, regulations, and policies.
- Avoiding Input that includes sensitive or regulated information unless you have an explicit agreement allowing such use. This includes:
- Protected Health Information (PHI) as defined by HIPAA or similar regulations.
- Government-issued identification numbers.
- Personal financial or banking details.
4. Healthcare Use
You may not use scalenow AI for healthcare-related activities unless:
- You have an active Business Associate Agreement (BAA) with scalenowAI.
- Your account is configured for healthcare AI use.
- Zero Data Retention is enabled for any PHI data you process.
If you use scalenow AI for healthcare purposes, you agree to:
- Test Input and Output for accuracy.
- Ensure employees, agents, and contractors comply with HIPAA, the BAA, and all applicable regulations.
- Only allow trained and licensed professionals to use scalenow AI for healthcare-related tasks.
- Not use scalenow AI for medical diagnosis, treatment recommendations, or clinical decision-making.
- Not mislead others into thinking scalenow AI output is generated by a human.
5. Usage Restrictions
You must not use scalenow AI to:
- Develop competing AI models or data sets.
- Generate misleading, fraudulent, or spam content.
- Violate laws, regulations, or technical policies.
- Modify or create derivative works of scalenow AI.
- Reverse-engineer, extract, or decompile scalenow AI algorithms or source code.
- Access data through unauthorized means.
- Buy, sell, or transfer API keys without scalenow AI prior consent.
6. Third-Party Compliance
If you use scalenow AI, you must not violate any policies from third-party AI providers (e.g., OpenAI, other AI services).
7. Disclaimer of Warranties
- scalenow AI makes no guarantees about the accuracy or reliability of AI-generated content.
- All Output is provided “as-is” and should not be relied upon without verification.
- AI-generated content may contain inaccuracies due to the evolving nature of machine learning.
8. Limitation of Liability
- scalenow AI is not responsible for incorrect or misleading Output.
- scalenow AI total liability for any damages, losses, or claims related to scalenowAI shall not exceed $100.
- scalenow AI may modify or discontinue AI features at any time.
9. No Medical or Professional Advice
- scalenow AI is not a substitute for human professionals, including physicians, legal experts, or financial advisors.
- scalenow AI is not responsible for healthcare decisions, billing, claims processing, or clinical research.
- The Output is not a medical device and should not be treated as such.
